Policy Update Newsletter: Federal Meaningful Use Exception

February 1, 2016 - CSRO along with other provider advocates worked with Congress last year to make it easier for physicians to receive Meaningful Use exceptions in 2015. This effort began as a result of CMS’s late publishing of MU Stage 2 requirements. As a result, legislation passed that allows CMS to approve hardship exceptions through March 15, 2016. Approved hardship exemption will exempt eligible professionals from the MU payment adjustment penalty in 2017.

CMS has now released the applications to apply for hardship exceptions for the 2015 Meaningful Use measures. Hardship exception applications and more information can be found on the CMS Payment Adjustments and Hardship Information section of CMS’s website.

Applications for a hardship exception must be filed under the "Extreme and Uncontrollable Circumstances" category. Practices should select the Section 2 category that is most appropriate to their situation. Those without other specific circumstances may be suited to use 2.2.d "EHR Certification/Vendor Issues (CEHRT Issues)." Once completed, the form can be emailed to ehrhardship@provider-resources.com or submitted by fax to (814) 456-7132.

Eligible professionals have until March 15, 2016 to apply for the “blanket” hardship. Late applications are due no later than July 1, 2016, and will be reviewed on a case-by-case basis. According to a CMS, 85% of hardship exemptions are approved.
